Definitions and interpretations

“Chroma” means Chroma Cars Media Ltd, 5B Church End Farm, Little Hadham, Hertfordshire SG11 2DY and can be referred to as ‘us’, ‘we’, ‘our’.

“T&C’s” means “Terms and conditions” or “terms” and can be interpreted as ‘Agreement’

‘User’ can be referred to as ‘you’, ‘your’, ‘advertiser’ ‘buyer’ or ‘seller’

‘www.carsforsalenearme.co.uk’ can be referred to as ‘website’ or ‘platform’

‘service’ can mean use of our website or any of the products and services we offer.

‘sale’ means the ‘contract’ or ‘agreement’ entered into between a buyer and seller on the website.

‘Advert’ means the vehicle record streamed to our website including all content, including pictures, video, text or artwork

Main Terms and conditions

These terms and conditions are an agreement between any user of the site and Chroma.

We are a vehicle marketing platform designed to offer an introductory only service between buyers and sellers of vehicles in the UK. This means we do not get involved in the sale of the vehicle in any way.

All information and guidance given on this website is purely for information purposes only. We do not guarantee the condition of the vehicles in any way. We have no control over what is advertised, however, if you feel a vehicle is being mis-represented, we will do all we can to ensure the vehicle is removed or it’s representation is amended.

All Users

• All users are responsible for conducting their own due diligence when purchasing a vehicle with regards to HPI or NMR checks, mechanical inspections or paperwork processing.

• It is the buyers responsibility to ensure the vehicle is mechanically sound and legally roadworthy before driving the vehicle.

• We are not liable for any compensation or damages that occur due to errors, omissions, condition of the vehicle, or any other issues.

• Chroma acts as an introductory service during your sale only. As such you should refer to the T&C’s of the user you are entering into business with. All Users waive any right to claim against Chroma in any respect, such as products, services, privacy practices, data storage, damage or losses caused by another user.

• We do not warrant or guarantee any product or service offered by another user.

• Lots of users are linked to this website. Each one with their own endorsements, affiliations and adverts. Chroma does not imply any sort of approval or endorsement of any kind to their contents.

• Always read all T&C’s, legal statements and any other conditions available from websites that are linked to us as. You enter these websites at your own risk.

• All users are expected to use adequate computer protection against viruses or harmful technologies that may harm us or any user of the website.

• By using our service you permit Chroma to forward your details to the user of the advert in which you have chosen.

Advertisements

• Chroma are not in any way liable for any actions, omissions or mis-representations of any kind regarding a user's advertisement. It is the advertisers sole responsibility for the content that they upload to our site and to check the advert for any errors, inaccuracies or omissions.

• We will remove any adverts, without refund, that post anything other than vehicle related data, content, video or photographs. This includes images or videos that are not originally made by the user or has any copyright, not owned by the user attached. You shall indemnify us against any loss suffered as a result of this.

• It is only permitted for each vehicle record to contain one vehicle advertised.

• It is the advertisers responsibility to ensure data is fed to us in the correct format and using the mandatory fields provided. We shall not be liable for content not appearing on the website where the user has failed to do this.

• Users shall only advertise vehicles they have the right to offer for sale by the owner of the vehicle.

• It is the advertisers responsibility to ensure all vehicles advertised are in accordance with the Advertising Standards Authority.

• We shall inform the relevant authorities should any user advertise any vehicle that is stolen and shall remove any content that we are instructed or recommended to by appropriate law enforcement or compliance authority.

• It is the users sole responsibility to ensure that each advert clearly states any history the vehicle has that would affect a buyer decision in purchasing it. This can include, but is not restricted to any vehicle that has had an odometer/mileage change or engine replacement; any vehicle previously used for hire & reward, emergency service vehicle or fleet vehicles and any other similar information. Your advert cannot imply anything differently to consumers.

• All URL links on adverts must link directly to the vehicle advertised only.

• Users are welcome to use our URL on their own advertising platform/website under the strict provision that the advertiser does not imply our endorsement or sponsorship. However, we reserve the right to request any links removal with immediate effect.

• We will terminate any account that streams content to our website that could damage our reputation, but is considered explicit, defamatory, inappropriate, liable or mis-leading.

• We reserve the right to change any inaccurate data that appears on our website.

• In the event that Chroma has any claims, disputes, or allegations made against them in relation to losses or damages arising from your content or sale; you agree to indemnify and hold Chroma and its staff and affiliates blameless.

The science bit!

• Security of your account details are the users responsibility to keep safe and private. Users must notify us immediately if their account suffers any sort of breach of security by an unauthorised third party.

• The account holder shall be held responsible for all activity that occurs under their login.

• It is the advertisers responsibility to ensure their own computer systems are compatible with our site with their own provider. Chroma shall not be responsible for unreceived or corrupt data feeds from third parties.

• You authorise us to copy, display, transmit, reformat, store and distribute all content that is submitted by you.

• We reserve the right to monitor all content entered on to our site by you and remove any content at our discretion without re-compensating to the user.

• We offer a Service uptime guarantee of 99% of available time per month. If for some reason we fail to maintain this service uptime guarantee in a particular month (as solely determined by us), you can contact us and request a credit on your Service fee for that month. The credit may be used only for the purchase of further products and services from Chroma Cars Media Limited, and is exclusive of any applicable taxes. The service uptime guarantee does not apply to service interruptions caused by: (1) periodic scheduled maintenance or repairs we may undertake from time to time; (2) interruptions caused by you or your activities; (3) outages that do not affect core Service functionality; (4) causes beyond our control or that are not reasonably foreseeable; and (5) outages which are related to the reliability of certain programming environments.

• In addition to other terms as set forth in the Agreement, you are prohibited from using the Website or its Content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.

• This Agreement does not transfer to you any intellectual property owned by Chroma or any third parties, and all rights, titles, and interests in and to such property will remain (as between the parties) solely with Chroma. All trademarks, service marks, graphics and logos used in connection with our Website or Services, are trademarks or registered trademarks of Chroma or our licensors. Other trademarks, service marks, graphics and logos used in connection with our Website or Services may be the trademarks of other third parties. Your use of our Website and Services grants you no right or license to reproduce or otherwise use any of Chroma or third-party trademarks.

Payment terms for Advertisers

• All Dealer registrations to our site are ‘Standard Monthly Rolling Package’ and may come with the initial 30 days free of charge.  

• From time to time we may offer a ‘Discounted Fixed Term Package’.  Any dealer that is on a ‘Standard Monthly Rolling Package’ can, by written request, move to a ‘Discounted Fixed Term Package’.

• Unless we are notified of cancellation in writing, any fixed term contracts shall automatically be put on our ‘Standard Monthly Rolling Package’ rates at the end of the term.  

• We can renew fixed term, discounted packages at your request.

• ‘Fixed Term Discounted’ packages cannot be changed mid contract.

• You shall pay all fees and charges in a timely manner and as directed by us.

• Accounts shall be suspended 30 days after non-payment of an invoice, but your account shall remain active and chargeable until 28 days notice is received from you in writing to cancel the account.  Dealers on ‘Discounted Fixed Term’ packages shall be liable for all payments until the end of the term.

• We reserve the right to charge an administration fee for all accounts that are not paid via our chosen method of payment.

• We reserve the right to change our package prices at any time.  You shall be given 7 days written notice, to the contact details given by you, of any changes in our prices.

• All invoices shall be sent out to the contact details provided by the Advertiser.  Invoices will be sent out prior to the 1st of every month, for payment via Direct Debit via GoCardless

• Should users exceed their agreed stock limit. Invoices shall be recalculated to account for the additional advertisements.

• Should there be any reason to dispute your invoice, please do so in writing within 7 days of receiving your invoice. Any claims made after this time shall not be able to be amended or reviewed and all charges will be due.

• Invoices are to be paid in full.

Cancellation of Accounts

•  We will terminate any accounts which are found to have false contact information or if it is found that the Advertiser has a criminal conviction custodial or otherwise that would affect the reputation of Chroma.

• Being able to advertise on carsforsalenearme.co.uk requires dealers to be able to prove the following, if requested to, within 24hrs by either a prospective customer or by us:

  • The company has been in business for 36mths or over

  • The company has a 3.0 Star or better Google rating

  • Full Vehicle History Report

  • Itemised list of reconditioning completed.

Although we will carry out random audits to ensure this criteria is being met, it is the advertisers responsibility to ensure that they can provide the above before registering with us and to inform us immediately if they can no longer fulfil these standards.   Any dealer found to not be able to meet the above prerequisite will have their account terminated without recompense.

• All cancellations need to be made in writing to cancellations@chromacarsmedia.co.uk or to Chroma Cars Media Limited, Unit 5B Church End Farm, Little Hadham, Hertfordshire SG11 2DY giving 28 days notice. You shall be liable for all charges until the end of the 28 days period. It is your responsibility to ensure we have received this notice.

• Chroma shall be entitled to serve 7 days notice to any advertiser.

Please check these Terms regularly as we reserve the right to change and amend them as we see fit. 

You confirm that you have read and understood all of the terms set out on this page and by using our services agree to be bound by its contents. We do not authorise anyone to use this site if they do not agree to these terms.
